- You had made reservation with us, consented to read, agreed and signed the mentioned terms & conditions.
- The terms "we", "us" and "our" refer to www.dive-indonesia.co.id. The term "you","your","renter" refers to the customer visiting our website, booking a reservation through us or otherwise using our services.
- These terms and conditions, together with Our Privacy Policy and any order form or payment instructions comprise the whole agreement between You and Us in relation to each order that We accept from You.
- By browsing the Site or submitting an order You agree to be bound by these terms and conditions.

Products and Suppliers
We sell a variety of travel or trip related products from different suppliers and service providers ("Suppliers"). Each Supplier has its own terms and condition that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them. Certain software and content found on our website are owned or licensed by us or our Suppliers, your use of which may be subject to further conditions. www.dive-indonesia.co.id is acting as organizer/booking agent for products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, insurance, etc.). We are not a co-vendor of such products and services. You will be referred into a separate contract with such Suppliers in connection with such products and services.

Warranties and Limitation of Liability
If, for any reason, you are dissatisfied with your holiday package, we want to hear about it. We recommend you contact us as soon as any incident arises.
For the avoidance of doubt, references here in to "us" "we" and "our" shall also refer to our affiliates. The information, software, products, and services provided by us or our suppliers or published on our website may include inaccuracies or errors, including pricing errors. We do not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to such information that appears on our website. We expressly reserve the right to correct any pricing errors on our website and/or on pending reservations made under an incorrect price. In such event, if available, we will offer you the opportunity to keep your pending reservation at the correct price or we will cancel your reservation without penalty.
Our goal is to provide excellent customer service and in order to do so we maintain strict quality monitoring.

Deposit and Payment
Any deposit from you are non-refundable. Payment of a deposit enables us to hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and other travel documents have been issued, subject to any terms and conditions of the Supplier. We will advise you of the date that full payment is required. Upon your provision of your payment information, you are authorizing us to make the payment arrangements with the corresponding Suppliers.
We reserve the right to refuse personal checks as a method of payment. After full payment, the conditions of the contract with your Supplier may permit them to increase the cost of your arrangements. If we are acting as your Booking Agent, we will pass on any such increase to you as we become aware of such increase. If we have arranged a package, changes in transportation costs including the cost of fuel, taxes, fees and exchange rates mean that the price of your travel arrangements may change after you have paid in full.

USD rate valid for Overseas or Foreign market

Payment Methods
- All payment instructions are sent to you by email when a payment is required.
- All payment method administration fee are to be paid by the sender.
- Payments may be made by : Bank Transfer / Internet Banking

In order to minimize your bank charges we recommend that you consider paying the full total of your package immediately, rather than first a deposit and then the balance at a later time.

Please help us to help you, by sending us a email copy of the transfer record that includes the transaction reference number.
Please be assured that if you have used our correct bank account number and SWIFT code above then your transfer will reach our account. Sometimes different addresses appear (from those quoted above) in other banks payment systems. Although it can be confusing, this is no cause for concern.

Cancellations and Changes
Your contract with your Suppliers may allow them to cancel or amend bookings. If we are your Wholesale/Organizer partner, we will ensure that you are promptly notified of any significant changes once we become aware of such change if there is time before your departure, but we accept no liability for any changes or costs incurred that may result. Subject to the Supplier’s terms and conditions, you will then have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements if one is made available by the Supplier, or canceling your booked arrangements and receiving any applicable refunds. We do not guaranty that any refunds will apply.
Where a change or cancellation requested by you to your travel arrangements is permitted and possible, our standard service fees will apply in addition to any additional Supplier charges. Please note that all reservation changes are subject to availability and the terms and conditions of the product purchased.

If you have to cancel your tour, services or package, we will charge the following:
* Any Deposit Non-refundable
* from the 90 day to the 61 day is 50%
* from the 60 day to 31 day is 75%
* from the 30 day to prior departure is 100%

Changes to Price Before Conclusion Of The Contract
Dive Indonesia™ reserves the right to make alterations and changes to brochure information, service descriptions and prices in the brochures and pricelists at any time before the time of booking. Should the necessity arise, Dive Indonesia™ will inform the agent or individual client prior to entering the contract. The date the contract is entered is the date that a booking fee is received by Dive Indonesia™.

Changes to Price After The Contract Has Been Entered
In rare circumstances, it is possible that prices must be increased. The circumstances under which this may occur are as follows:
- Increases in transportation costs (including fuel costs) Increases in state taxes and duties (i.e. embarkation/disembarkation fees, sales taxes etc.) Currency fluctuations.
- Dive Indonesia™ reserves the right to raise the agreed price up to 7 days prior to departure.

Travel Documents and Destinations
It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc.
Prior to booking international travel/holiday/tour, we recommend that you review any. Government’s prohibitions, warnings and advisories applicable to your destinations. By offering travel/holiday/tour to any particular destination, we do not represent that travel in such destination is safe or without risk.
is your responsibility to fulfil the passport, visa and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.
You are also required to carry a valid International Student I.D., and International Youth I.D. or an International Teacher I.D. card if you are traveling on a special student/youth/teacher ticket.

Adventure Travel
I am aware that an adventure trip, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which may include physical exertion for which I may not be prepared, weather extremes which can subject to sudden and unexpected change, remoteness from normal medical services, and evacuation difficulties if I am disabled.

Diving Requirements
You must dive strictly within the limits of and meeting the requirements of your current qualifications and experience and agency standards. You must not dive alone. In order to dive whilst on holiday with us you must hold a minimum qualification Open Water Diver [or Junior Open Water Diver] or equivalent from a recognized agency (as judged by the Company) except where you have booked a holiday, one of the purposes of which is, to obtain that minimum qualification. Clients must submit evidence of their diving qualifications to the Dive Guide/Divemaster/Instructor at the dive center, liveaboard or dive site and if, requested to the Company prior to departure before diving can commence. All clients participating in scuba diving must be in good health and not have any medical history of lung disorders, asthma, epilepsy, diabetes or recent surgery and agree to discontinue diving if respiratory congestion takes place during the holiday. If you have any medical condition contrary to these requirements you must produce a diving medical certificate of fitness prior to diving. If you fail to produce evidence of satisfactory diving qualifications or medical certificates we or the Dive Guide/Divemaster/Instructor will be entitled to prevent you from taking your holiday and/or diving. In this case neither we nor the Dive Guide/Divemaster/Instructor or other applicable dive supplier will have any liability to provide you with any refunds or compensation in respect of any diving you are unable to take part in as a result or you being prevented from traveling on your holiday. Please note: Diving activities carry inherent risks. You must behave in a fit and proper manner at all times in accordance with all recognized diving practices and procedures and take proper responsibility for your own safety. Certain diving sites are very remote, either by distance or time or both, from a recompression chamber. If you participate in such activities you may be asked by the supplier to sign ‘liability releases & assumptions of risk’ and ‘medical disclaimer’ forms and/or provide a current medical and in all cases must adhere to the restrictions imposed by the diving supplier/ instructor. Copies of relevant forms are available, prior to departure, on request from ourselves or the dive supplier concerned.

Snorkeling Tours
The snorkeling tours are normally in the open ocean, often in deep water, additionally the surface conditions may be choppy. All participants should be able to swim and be comfortable swimming in the open ocean. Participants should have reasonable snorkeling skills and be comfortable snorkeling in open ocean waters. It is the responsibility of participants to assess their ability level and suitability for any given snorkeling site and it’s prevailing conditions on the day and confer with the guide if problems arise. We suggest that you get out and do as much open water (ocean) snorkeling as possible before departure. This will allow your holiday to be more enjoyable.

Equipment Rental
Modifying the equipment is strictly forbidden. Equipments are tested before rental, which implies that the renter does accept its working condition. The renter certifies all security warnings, risks and precautions to be taken concerning the use of the equipment rented through this agreement. The agreement is a release of the renter’s rights to sue for injuries or death resulting from the rental and/or use of this equipment. Renter expressly assumes all risks of snorkeling and/or scuba diving related in any way to the rental and/or use of this equipment. Whatever the mode of transport and / or assembly, the renter is responsible for the equipment as soon as they leave the owner. The renter is expected to know the operation and handling of the equipment, so he will be held responsible for any misuse. Under no circumstances can the owner be held responsible for any bodily injury or material damage resulting from the renter use of his equipment. The rented equipment can not be re-rented, sold, given or pledged.  In case of confiscation, fine, or other due to non-compliance legislation, the renter will be held responsible.
Renter affirm it is my responsibility to inspect all of the equipment and acknowledge it is in good working condition. Renter affirm that it is my responsibility to check both the quality and quantity of gas in any scuba tanks. Renter acknowledge that I should not dive if the equipment is not functioning properly. Renter will not hold the Released Parties responsible for my failure to inspect the equipment prior to diving or if renter choose to dive with equipment that may not be functioning properly.
Renter agree to reimburse for the loss or breakage of any and all equipment at the current replacement value and to also pay for damages incurred while transporting the equipment. Renter agree to return the equipment in clean condition and to pay a cleaning fee if not returned cleaned..

Understanding and Complying with the Aspects of Conservation.

Liability Release Forms
Before the trip you will be required to sign a liability waiver release before departure. If taking courses a medical questionnaire is also standard, please bring any medical conditions to the attention of the scuba instructor / trip leader / dive leader and produce a doctor's medical clearance for diving upon arrival.

Force majeure, Unforeseen events or other similar reasons
Dive Indonesia™ or operator have right to cancel a charter when unexpected events imposed on operator, suspended operations by government / authorities or endangering the safety of our customer such us : natural disaster (hurricane, tsunami, earthquake, volcanic, flood and etc ) civil or international war, political or economic disturbances, terrorist threat or activity, pandemic, fire, climatic ,you will be informed as soon as is possible.
We strongly recommend to our guests that they purchase a fully comprehensive travel insurance package that covers; accidents, medical assistance, baggage, trip cancellation and interruption, personal liability and effects, when a reservation is made. All guests should ensure they have appropriate insurance to cover the activities they will be undertaking during their trip, regardless of risk. Please be advised that if guests choose not to carry travel insurance, Dive Indonesia™ will not be held responsible for any financial disappointment caused by reasons beyond our control.

Your Responsibility
When you book with us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss must be paid direct at the time to the accommodation owner or manager or other supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party’s full legal costs) as a result of your actions. We expect all clients to have consideration for other people. If in our reasonable opinion or in the reasonable opinion of any other person in authority, you or any member of your party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we are entitled, without prior notice, to terminate the holiday of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation or other service. We will have no further responsibility toward such person(s) including any return travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.

Our Responsibility
• We promise to make sure that the holiday arrangements we have agreed to make, perform or provide as applicable as part of our contract with you are made, performed or provided with reasonable skill and care.
• We will not be responsible for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following: the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party or the act(s) and/or omission(s) of a third party not connected with the provision of your holiday and which were unforeseeable or unavoidable or ‘force majeure’
• Please note, we cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which your hotel or any other supplier agrees to provide for you where the services or facilities are not advertised in our brochure or on our website and we have not agreed to arrange them and any excursion you purchase in resort. In addition, regardless of any wording used by us on our website, in any of our Information Sheets or elsewhere, we only promise to use reasonable skill and care as set out above and we do not have any greater or different liability to you. The promises we make to you about the services we have agreed to provide or arrange as part of our contract - and the laws and regulations of the country in which your claim or complaint occurred - will be used as the basis for deciding whether the services in question had been properly provided. If the particular services which gave rise to the claim or complaint complied with local laws and regulations applicable to those services at the time, the services will be treated as having been properly provided.
• Please note, we cannot accept any liability for any damage, loss, expense or other sum(s) of any description (1) which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you or (2) which did not result from any breach of contract or other fault by ourselves or our employees or, where we are responsible for them, our suppliers. Additionally we cannot accept liability for any business losses.

Waiver
In entering into this agreement, I am not relying on any oral, written, or visual representations or statements by www.dive-indonesia.co.id or its staff or any other inducement or coercion to go on the adventure trip, hence, only of my own free will.

All information in the website is subject to change. www.dive-indonesia.co.id reserves the right to add/change/correct mistakes that may possibly appear in the website or published price lists.
