- PURCHASE OF SERVICES: scuba dive packages, single scuba dives, scuba diving courses, scuba diving experiences, snorkeling packages, snorkeling trips, sea excursions and sea activities in general, hire of scuba equipment, hire of boats, any service offered and fulfilled by our destinations.
- PURCHASE OF GOODS: dive equipment, water sports equipment, accessories, and in general goods that need to be physically transferred from warehouse our partners to the location specified by the buyer.



Products and Suppliers
We sell a variety of travel or trip related products from different suppliers and service providers ("Suppliers"). Each Supplier has its own terms and condition that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them. Certain software and content found on our website are owned or licensed by us or our Suppliers, your use of which may be subject to further conditions. is acting as organizer/booking agent for products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, etc.). We are not a co-vendor of such products and services. You will be entering into a separate contract with such Suppliers in connection with such products and services.

Warranties and Limitation of Liability
If, for any reason, you are dissatisfied with your holiday package, we want to hear about it. We recommend you contact us as soon as any incident arises.
For the avoidance of doubt, references here in to "us" "we" and "our" shall also refer to our affiliates. The information, software, products, and services provided by us or our suppliers or published on our website may include inaccuracies or errors, including pricing errors. We do not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to such information that appears on our website. We expressly reserve the right to correct any pricing errors on our website and/or on pending reservations made under an incorrect price. In such event, if available, we will offer you the opportunity to keep your pending reservation at the correct price or we will cancel your reservation without penalty.
Our goal is to provide excellent customer service and in order to do so we maintain strict quality monitoring.

Deposits and Payment
Any deposits from you are non-refundable. Payment of a deposit enables us to hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and other travel documents have been issued, subject to any terms and conditions of the Supplier. We will advise you of the date that full payment is required. Upon your provision of your payment information, you are authorizing us to make the payment arrangements with the corresponding Suppliers.
We reserve the right to refuse personal checks as a method of payment. After full payment, the conditions of the contract with your Supplier may permit them to increase the cost of your arrangements. If we are acting as your Booking Agent, we will pass on any such increase to you as we become aware of such increase. If we have arranged a package, changes in transportation costs including the cost of fuel, taxes, fees and exchange rates mean that the price of your travel arrangements may change after you have paid in full.

Payment Methods
All payment instructions are sent to you by email when a payment is required.
All bank transfer charges are to be paid by the sender.

In order to minimise your bank charges we recommend that you consider paying the full total of your package immediately, rather than first a deposit and then the balance at a later time.

Please help us to help you, by sending us a email copy of the transfer record that includes the transaction reference number.
Please be assured that if you have used our correct bank account number and SWIFT code above then your transfer will reach our account. Sometimes different addresses appear (from those quoted above) in other banks payment systems. Although it can be confusing, this is no cause for concern.

Cancellations and Changes
Your contract with your Suppliers may allow them to cancel or amend bookings. If we are your Organizer/Booking Agent, we will ensure that you are promptly notified of any significant changes once we become aware of such change if there is time before your departure, but we accept no liability for any changes or costs incurred that may result. Subject to the Supplier’s terms and conditions, you will then have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements if one is made available by the Supplier, or canceling your booked arrangements and receiving any applicable refunds. We do not guaranty that any refunds will apply.
Where a change or cancellation requested by you to your travel arrangements is permitted and possible, our standard service fees will apply in addition to any additional Supplier charges. Please note that all reservation changes are subject to availability and the terms and conditions of the product purchased.

If you have to cancel your tour, services or package, we will charge the following:
* outside 61 days prior tour or package is 25%
* from the 60th day to the 31th day is 50%
* from the 45th day to 16th day is 75%
* from the 30th day to 1 day prior departure is 100%

Travel Documents and Destinations
It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc.
Prior to booking international travel/holiday/tour, we recommend that you review any. Government’s prohibitions, warnings and advisories applicable to your destinations. By offering travel/holiday/tour to any particular destination, we do not represent that travel in such destination is safe or without risk.
is your responsibility to fulfil the passport, visa and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.
You are also required to carry a valid International Student I.D., and International Youth I.D. or an International Teacher I.D. card if you are traveling on a special student/youth/teacher ticket.

Adventure Travel
I am aware that an adventure trip, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which may include physical exertion for which I may not be prepared, weather extremes which can subject to sudden and unexpected change, remoteness from normal medical services, and evacuation difficulties if I am disabled.

Diving Requirements
You must dive strictly within the limits of and meeting the requirements of your current qualifications and experience and agency standards. You must not dive alone. In order to dive whilst on holiday with us you must hold a minimum qualification Open Water Diver [or Junior Open Water Diver] or equivalent from a recognised agency (as judged by the Company) except where you have booked a holiday, one of the purposes of which is, to obtain that minimum qualification. Clients must submit evidence of their diving qualifications to the Dive Guide/Divemaster/Instructor at the dive centre, liveaboard or dive site and if, requested to the Company prior to departure before diving can commence. All clients participating in scuba diving must be in good health and not have any medical history of lung disorders, asthma, epilepsy, diabetes or recent surgery and agree to discontinue diving if respiratory congestion takes place during the holiday. If you have any medical condition contrary to these requirements you must produce a diving medical certificate of fitness prior to diving. If you fail to produce evidence of satisfactory diving qualifications or medical certificates we or the Dive Guide/Divemaster/Instructor will be entitled to prevent you from taking your holiday and/or diving. In this case neither we nor the Dive Guide/Divemanster/Instructor or other applicable dive supplier will have any liability to provide you with any refunds or compensation in respect of any diving you are unable to take part in as a result or you being prevented from traveling on your holiday. Please note: Diving activities carry inherent risks. You must behave in a fit and proper manner at all times in accordance with all recognised diving practices and procedures and take proper responsibility for your own safety. Certain diving sites are very remote, either by distance or time or both, from a recompression chamber. If you participate in such activities you may be asked by the supplier to sign ‘liability releases & assumptions of risk’ and ‘medical disclaimer’ forms and/or provide a current medical and in all cases must adhere to the restrictions imposed by the diving supplier/ instructor. Copies of relevant forms are available, prior to departure, on request from ourselves or the dive supplier concerned.

Snorkelling Tours
The snorkelling tours are normally in the open ocean, often in deep water, additionally the surface conditions may be choppy. All participants should be able to swim and be comfortable swimming in the open ocean. Participants should have reasonable snorkelling skills and be comfortable snorkelling in open ocean waters. It is the responsibility of participants to assess their ability level and suitability for any given snorkelling site and it’s prevailing conditions on the day and confer with the guide if problems arise. We suggest that you get out and do as much open water (ocean) snorkelling as possible before departure. This will allow your holiday to be more enjoyable.

Understanding and Complying with the Aspects of Conservation.

Force majeure, Unforeseen eventsor other similar reasons
Dive Indonesia or operator have right to cancel a charter when unexpected events imposed on operator, suspended operations by government / authorities or endangering the safety of our customer such us : natural disaster (hurricane, tsunami, earthquake, volcanic, flood and etc ) civil or international war, political or economic disturbances, terrorist threat or activity, fire, climatic ,you will be informed as soon as is possible.
For your information Dive Indonesia will not give any compensation for that cancellation but we will provide replacement trip , base on the consent between Dive Indonesia and the customer.
We advise you to take travel insurance , no refund if a trip is cancellation because of medical emergency, Flight connection was missed due to airline schedule, Lost, stolen or damaged baggage, personal effects or travel documents, Delayed baggage (and emergency replacement of essential items) while traveling or transit.

Your Responsibility
When you book with us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss must be paid direct at the time to the accommodation owner or manager or other supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party’s full legal costs) as a result of your actions. We expect all clients to have consideration for other people. If in our reasonable opinion or in the reasonable opinion of any other person in authority, you or any member of your party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we are entitled, without prior notice, to terminate the holiday of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation or other service. We will have no further responsibility toward such person(s) including any return travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.

Our Responsibility
• We promise to make sure that the holiday arrangements we have agreed to make, perform or provide as applicable as part of our contract with you are made, performed or provided with reasonable skill and care.
• We will not be responsible for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following: the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party or the act(s) and/or omission(s) of a third party not connected with the provision of your holiday and which were unforeseeable or unavoidable or ‘force majeure’
• Please note, we cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which your hotel or any other supplier agrees to provide for you where the services or facilities are not advertised in our brochure or on our website and we have not agreed to arrange them and any excursion you purchase in resort. In addition, regardless of any wording used by us on our website, in any of our Information Sheets or elsewhere, we only promise to use reasonable skill and care as set out above and we do not have any greater or different liability to you. The promises we make to you about the services we have agreed to provide or arrange as part of our contract - and the laws and regulations of the country in which your claim or complaint occurred - will be used as the basis for deciding whether the services in question had been properly provided. If the particular services which gave rise to the claim or complaint complied with local laws and regulations applicable to those services at the time, the services will be treated as having been properly provided.
• Please note, we cannot accept any liability for any damage, loss, expense or other sum(s) of any description (1) which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you or (2) which did not result from any breach of contract or other fault by ourselves or our employees or, where we are responsible for them, our suppliers. Additionally we cannot accept liability for any business losses.

In entering into this agreement, I am not relying on any oral, written, or visual representations or statements by (Javalindo Buana, PT) or its staff or any other inducement or coercion to go on the adventure trip, hence, only of my own free will.

Returning wrong size or faulty goods
- If any product that is purchased does not turn out to be the correct size for You then We will exchange it for the correct size provided that the product has not been used in any way and is returned to Us in its original packing "as new". Any product that is returned for an exchange must be accompanied by the original delivery note with the return section fully completed with the reason for exchange within the specified returns period printed on Your delivery note.
- If any product that is purchased is faulty We will exchange it for an identical replacement free of charge provided that the product is returned to Us in its original packaging and the fault is notified to Us. The provision of a replacement item is conditional on Our engineers first verifying the reported fault.
- At Dive Indonesia We want You to be confident that You have the full support of Our technical team when making a purchase and that should any product prove to be faulty We will ensure it is repaired and return to You with the least disruption. Should You believe that any product You have purchased from Us is faulty, first e-mail Us letting Us know what the problem is. Give Us as much detail as You can. One of Our technicians will then contact You to discuss the best course of action. If the item needs to be returned to Us You can be assured either Our technicians or the manufacturer's technicians will remedy the problem as quickly as possible.

• We reserve the right to edit or delete any ads that violates our terms of service/use.

Dive Indonesia (the "Service") is provided to you ("User") under the terms and conditions listed on this website. These terms and conditions include any amendments made now or in the future as well as any further rules or policies that may be posted on the website.


Dive Indonesia reserves the right to modify or discontinue either temporarily or permanently, the Service with or without notice to User. User agrees that Dive Indonesia shall not be liable to User or any third-party for any modification or discontinuation of the Service.

User agrees to abide by all laws and regulations in User's use of the Service. User agrees to be solely responsible for the contents of User's ads through the Service.

User agrees that Dive Indonesia may terminate User's ads or use of the Service if Dive Indonesia believes that (a) User has violated or acted inconsistently with this agreement, or that (b) User has violated the rights of Dive Indonesia or other Users.
User acknowledges and agrees that any termination of service under this Agreement and under any provision of this Agreement may be effected without prior notice. User also acknowledges and agrees that Dive Indonesia may immediately delete any ads associated






Applicant certifies the statements made on the reverse regarding Applicant’s experience to be correct and acknowledges that Applicant understands that Applicant’s acceptance on this trip is predicated on Applicant’s assurance that Applicant is physically fit to engage in ocean SCUBA diving and that Applicant has had sufficient training to engage in ocean SCUBA diving. Applicant fully understands that SCUBA diving is hazardous and potentially dangerous and Applicant is fully aware and understands the inherent risks in SCUBA diving due to known and unknown causes and Applicant voluntarily assumes all risks of loss, damage or injury that may be sustained by Applicant while engaged in said diving travel programs.

Applicant, for Applicant and Applicant’s personal representatives, assigns, heirs, and next of kin, hereby rele ases, waives and discharges and its officers, agents and employees, hereinafter called “Releasees”, from all liability to Applicant, Applicant’s personal representatives, assigns, heirs, and next of kin for all loss or damage, and any claim or demand therefore, on account of injury to the person or property or resulting in the death of Applicant, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES or otherwise, while Applicant is engaged in an diving travel program, and Applicant covenants not to bring any action against or any other Releasee arising out of such loss or damage.

Applicant warrants that the statements made in Applicant’s application and herein are true and correct and understands that the Releasees will rely on them and that such statements will be an inducement to in accepting Applicant as a participant in a diving travel program. reserves the right to deny any Applicant for any reason whatsoever.

It is expressly understood and agreed that assumes no responsibility or liability for service, transportation or equipment made available by any resort, hotel or other person or entity, either as to its availability or as to its safety, quality or condition, nor for the acts (negligent or otherwise) of any employee or agent of such establishment, firm, person, or entity. It is also understood and agreed that does not, by acceptance of this Applicant, assume any responsibility or liability for the safety of any participating individual, particularly while such individual is engaged in underwater activities, whether alone or in groups, under the supervision of tour escort, or otherwise.

It is expressly understood that the tour escort (or escorts) of the trip for which the Applicant has signed up, is acting only in the capacity of a tour escort. Although the tour escort may or may not be a certified SCUBA instructor, and will give freely of his/her diving knowledge and experience, he/she is not acting in the capacity of instructor, unless agreed upon by separate payment and release between Applicant and Releasee.

It is further understood that remoteness of the area, local customs and prevailing weather conditions may cause substitution of facilities and/or equipment, minor inconvenience or modification to the diving portions of the program itinerary and reserves the right to modify and/or cancel diving arrangements due to unfavorable weather conditions and substitute comparable facilities and equipment.

No refunds can be made for canceled diving arrangements due to adverse weather, or for substitution of facilities and/or equipment or for minor inconvenience.

Applicant hereby indemnifies and holds harmless and its partners, agents and employees from any and all claims, suits, liability, injuries, losses and damages of any person which arise out of Applicant’s participation in a diving travel program.

All trip pricing is subject to change due to fluctuating airfares, taxes, fuel charges, or changes in suppliers anditineraries that may be necessitated. Price changes in this regard do not release applicant from provisions contained in this statement.

Applicant acknowledges receipt of information regarding trip cancellation insurance. This protection can save you money if you are forced to cancel or alter your trip. Application for this coverage is the responsibility of the applicant.

The application form signed by Applicant and by parent or guardian of any minor Applicant is in all respects subject to the terms and conditions above, which have been read and unconditionally agreed to. I/we further agree to observe strictly and co mply with such additional reasonable terms and regulations as may from time to time deem desirable or needful or prescribe during the course of the program.

Applicant declares that Applicant has read and understands the contents thereof and voluntarily signs this General Release, Assumption of Risk, Waiver of Liability and Indemnity Agreement. No oral or other representations, statements or inducements have been made to Applicant, apart from this application and this General Release, Assumption of Risk, Waiver of Liability and Ind emnity Agreement.

Applicant in executing this General Release, Assumption of Risk, Waiver of Liability and Indemnity Agreement shall be deemed to have executed it for Applicant, Applicant’s heirs, executors, administrators, successors, assigns, and next of kin.

Applicant acknowledges receipt of a copy of this General Release, Assumption of Risk, Waiver of Liability and IndemnityAgreement.
